By using this Site you consent and agree to the terms and conditions contained in this Agreement. These terms and conditions ("Agreement") applies to use of the grocerywaale.com website located at http://www.grocerywaale.com (the "Site"). The Site is the property of SBT Marketing Pvt Ltd (SBT, "we", "our", "us").

Services overview

Grocerywaale.com is a unique service where you can choose from a wide range of around 5,000+ products related to your home needs (Frozen & Fresh Food, Grocery, Cosmetics, Detergents, Stationery etc) and allows you to place your order either online, on phone or email and get them delivered at your door step. We deliver goods through our own delivery service thereby maintaining the quality and freshness of the products.

Eligibility

Services of grocerywaale.com would be available to only select residential and office clusters. The residents and employees of these clusters would be able to register at the site and sign up for membership. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including un-discharged insolvents etc. are not eligible to use the Site. If you are a minor i.e. under the age of 18 years but at least 13 years of age you may use this Website only under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use. If your age is below that of 18 years your parents or legal guardians can transact on behalf of you if they are registered users. You are prohibited from purchasing any material which is for adult consumption the sale or purchase of which to/by minors are strictly prohibited

License and site access

Grocerywaale.com grants you a limited license to access and make personal use of this site and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of grocerywaale.com. This license does not include any resale or commercial use of this site or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this site or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools. This site or any portion of this site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of grocerywaale.com. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of grocerywaale.com and our affiliates without express written consent. You may not use any meta tags or any other "hidden text" utilizing grocerywaale.com’sname or trademarks without the express written consent of SBT. Any unauthorized use terminates the permission or license granted by SBT.

Account & Registration Obligations

All shoppers would have to register and login for placing orders on grocerywaale.com. After registration you may decide to shop by becoming a member or as a non-member. You have to keep your account and registration details current and correct. If you relocate to a new complex where grocerywaale.com does not provides its services then you should inform us by writing to customerservice@grocerywaale.com. We will make necessary amendments to your customer status and refund unused membership fee if any.

Pricing

All the products listed on grocerywaale.com will be sold at MRP unless otherwise specified. The prices mentioned at the time of ordering are the indicative prices and the applicable prices will be the actual prices on the date of the delivery. Although prices of most of the products do not fluctuate on a daily basis but some of the commodities and fresh food prices do change on a daily basis. Since you can place an order upto 30 days in advance from the actual delivery date we need to accommodate for these price fluctuations and therefore any difference in the bill value on the date of placing the order and the bill value as per the prices applicable on the date of delivery will be collected / refunded in cash at the time of the delivery of the order.

Cancellation by Customer

We allow our customers to cancel the orders before and after the cutoff time. If the order is cancelled before the cutoff time, the money paid thereon is refunded to the respective bank account of the customer. However, if the customer cancels the order post cut off time. The amount paid thereon is credited to the respective customer’s account. The customer, for shopping in future, can then use this amount. We can also remit the money if the customer writes to us on customerservice@grocerywaale.com.

Return & Refunds

Ammendment of Order

We empower our cutomers to amend the order till the cut off time of 06:00 a.m. Beyond the cut off time the order cannot be amended.

Return of Goods during Delivery

We offer our customers a no questions asked Return Policy wherein they are empowered to return the goods at the time of delivery. If the cutomer has already paid for the goods so returned, the equal amount shall be remitted to the customer’s account, which can be used when you shop with us next. However, we do not accept return of goods after the delivery has been completed. The delivery is said to be complete when the customer or any person authorized by the customer signs the copy of receipt offered by our Delivery Executive.

Refunds

Grocerywaale.com also has a refund policy. If the order has been cancelled before the cutoff time of 06:00 a.m. the whole amount shall be remitted to your account. However, if the order is cancelled after the cut off time, the amount shall be credited to your account with us. This amount can be used for shopping with us in future. Also, if the customer drops in an email at customerservice@grocerywaale.com we can facilitate the refund to your respective bank account.

You Agree and Confirm

1. That in the event that a non-delivery occurs on account of a mistake by you (i.e. wrong name or address or any other wrong information) any extra cost incurred by Grocerywaale.com for redelivery shall be claimed from you.
2. That you will use the services provided by Grocerywaale.com, its affiliates, consultants and contracted companies, for lawful purposes only and comply with all applicable laws and regulations while using the Website and transacting on the Site.
3. You will provide authentic and true information in all instances where such information is requested of you. Grocerywaale.com reserves the right to confirm and validate the information and other details provided by you at any point of time. If upon confirmation your details are found not to be true (wholly or partly), we have the right in its sole discretion to reject the registration and debar you from using the Services and / or other affiliated websites without prior intimation whatsoever.
4. That you are accessing the services available on this Website and transacting at your sole risk and are using your best and prudent judgment before entering into any transaction through this Website.
5. That the address at which delivery of the product ordered by you is to be made will be correct and proper in all respects.
6. That before placing an order you will check the product description carefully. By placing an order for a product you agree to be bound by the conditions of sale included in the item's description.

You may not use the Website for any of the following purposes:

1. Disseminating any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material.
2. Transmitting material that encourages conduct that constitutes a criminal offence results in civil liability or otherwise breaches any relevant laws, regulations or code of practice. 
3. Gaining unauthorized access to other computer systems. 
4. Interfering with any other person's use or enjoyment of the Site. 
5. Breaching any applicable laws;
6. Interfering or disrupting networks or web sites connected to the Site.
7. Making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.

Colours and Size

We have made every effort to display the coloursand size of our products that appear on the Website as accurately as possible. However, as the actual colours you see will depend on your monitor and other technical constraints. We cannot guarantee that your monitor's display of any colour will be accurate.

Modification of Terms & Conditions of Service

Grocerywaale.com may at any time modify the Terms & Conditions of Use of the Website without any prior notification to you. You can access the latest version of these Terms & Conditions at any given time on Grocerywaale.com. You should regularly review the Terms & Conditions on Grocerywaale.com. In the event the modified Terms & Conditions is not acceptable to you, you should discontinue using the Service. However, if you continue to use the Service you shall be deemed to have agreed to accept and abide by the modified Terms & Conditions of Use of this site.

Governing Law and Jurisdiction

This User Agreement shall be construed in accordance with the applicable laws of India. The Courts at Delhi and Haryana shall have exclusive jurisdiction in any proceedings arising out of this agreement.

Any dispute or difference either in interpretation or otherwise, of any terms of this User Agreement between the parties hereto, the same shall be referred to an independent arbitrator who will be appointed by SBT Marketing Private Limited. and his decision shall be final and binding on the parties hereto. The above arbitration shall be in accordance with the Arbitration and Conciliation Act, 1996 as amended from time to time. The arbitration shall be held in Haryana/ Delhi. The High Court of judicature at Delhi/ Haryana alone shall have the jurisdiction and the Laws of India shall apply. Reviews, Feedback, Submissions

All reviews, comments, feedback, postcards, suggestions, ideas, and other submissions disclosed, submitted or offered to Grocerywaale.com on or by this Website or otherwise disclosed, submitted or offered in connection with your use of this Website (collectively, the "Comments") shall be and remain our property. Such disclosure, submission or offer of any Comments shall constitute an assignment to SBT Marketing Private Limited of all worldwide rights, titles and interests in all copyrights and other intellectual properties in the Comments. Thus, SBT Marketing Private Limited owns exclusively all such rights, titles and interests and shall not be limited in any way in its use, commercial or otherwise, of any Comments. You agree to defend, indemnify and hold harmless Grocerywaale.com, its employees, directors, officers, agents and their successors and assigns from and against any and all claims, liabilities, damages, losses, costs and expenses, including attorney's fees, caused by or arising out of claims based upon your actions or inactions, which may result in any loss or liability to Grocerywaale.com or any third party including but not limited to breach of any warranties, representations or undertakings or in relation to the non-fulfilment of any of your obligations under this User Agreement or arising out of the your violation of any applicable laws, regulations including but not limited to Intellectual Property Rights, payment of statutory dues and taxes, claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of intellectual property or other rights. This clause shall survive the expiry or termination of this User Agreement.

Termination

This User Agreement is effective unless and until terminated by either you or Grocerywaale.com. You may terminate this User Agreement at any time, provided that you discontinue any further use of this Site. Grocerywaale.com may terminate this User Agreement at any time and may do so immediately without notice, and accordingly deny you access to the Site, Such termination will be without any liability to Grocerywaale.com. Upon any termination of the User Agreement by either you or Grocerywaale.com, you must promptly destroy all materials downloaded or otherwise obtained from this Site, as well as all copies of such materials, whether made under the User Agreement or otherwise. Grocerywaale.com 's right to any Comments shall survive any termination of this User Agreement. Any such termination of the User Agreement shall not cancel your obligation to pay for the product already ordered from the Website or affect any liability that may have arisen under the User Agreement.

Offers and Discounts

For promotion purposes grocerywaale.com shall run various discounts, offers, combo deals and other promotional deals. Any offer/discount code running on site cannot be clubbed with any other offer/discount. GW reserves the right to withdraw the offer at any time point of time. GW is not liable to compensate the customer for the same once the offer is withdrawn. Any free products being offered by the brands being displayed on grocerywaale.com may be out of stock. It is the responsibility of customer to check the same with the grocerywaale.com team and confirm whether any such deals are being offerred by grocerywaale.com to the customers. This is due to the fact that grocerywaale.com may not have the stock with which the promotional deal is being offerred by the brand in question.

Order Delivery

1. Customers are required to check the goods thoroughly when being delivered. Any goods delivered incorrectly with respect to, including but not limited to, Brand, Quantity, Flavor or variant of the product, Raw materials, different MRP, packaging should be pointed out at the time of delivery. No replacements with respect to the aforementioned criteria will be entertained once the customer has signed the receiving on the copy of the invoice.
2. If there are any replacements at the time of delivery or if the customer feels that he has ordered more than what is required, he/she can return the goods so ordered. Provided the goods so returned should not exceed 25% of the value of the total bill.
3. If the customer has accepted certain goods at the time of delivery and finds that the goods are not as per the generally accepted quality standards, he/she has the option of getting the goods replaced. However, such goods shall only be replaced, if the customer notifies the GW team about the issue within 5 days of the date of delivery. 4. If the customer is delegating the acceptance of delivery to some other person, the same conditions shall apply as if the order is being delivered to the customer himself. The receiving given by the other person shall be treated as the receiving by the customer himself/herself.
5. If the customer is not found at the address at the allotted time and date of delivery, GW shall charge the customer INR 50 for the next time delivery.
6. If the customer is paying through Sodexo or Ticket Restaurant coupons, he/ she is not allowed receive the cash/ change against the coupons so provided.
7. If the customer has selected the card on delivery option and the customer is unable to make the payment through the Mobile EDC machine so provided by the GW team, he/ she is required to pay the delivery staff by cash only. No Sodexo or Ticket restaurant coupons shall be accepted.

1. The product should be of the same brand
2. The quantity of the product should be the same
3. The packaging of both the products should be the same
4. The MRP of both the products should be the same
5. The consumer should be able to show the cheaper product to the representative from SBT Marketing Private Limited and also produce the VAT PAID bill, which shows that the consumer has legitimately purchased the product after paying all the taxes payable as per Indian tax laws.
6. The consumer should have the screen shot of the relevant page depicting the product in question, clearly showing the GW price of the product.
7. The date of the VAT paid bill i.e. the date of purchase should not be more than 4 days old than the screen shot clicked by the consumer. The same is necessary because the prices of the products change on a daily basis.
8. The price challenge only applies to Dry groceries listed on the website. It does not apply to any utensils, cleaning articles, fruits, vegetables, apparels and gift items.
